American Medical Response, Inc. and its subsidiary Life Line, Inc., collectively known as American Medical, filed an appeal after the Maricopa County Superior Court dismissed their quo warranto claim against Jennifer Cunico, Executive Director of the Arizona Department of Health Services. The appeal was heard by the Arizona Court of Appeals, Division One. American Medical challenged a $550 paramedic ride-along fee imposed by the Central Arizona Fire and Medical Authority through Resolution 2022-06. They argued that this fee usurped the exclusive authority of the Department to regulate ambulance service charges. However, the court found that American Medical failed to state a valid claim for relief under quo warranto or join necessary parties under Rule 19. Consequently, the court affirmed the dismissal of their claims.
