In a legal battle unfolding in the United States District Court for the District of Arizona, plaintiffs Bola T. Akinyemi and Carol K. Kluevein have filed a lawsuit against Springs at Westgate Apartments, also known as Continental Properties. The case, filed on October 17, 2025, alleges multiple grievances including fraud, unfair business practices, breach of contract, dereliction of fiduciary duties, and unjust enrichment.
The plaintiffs claim that after entering into a lease agreement with the defendants in April 2025, they faced discrimination and improper eviction proceedings. Despite attempts to resolve payment issues through a promissory note and discussions with the defendants’ attorneys, they were evicted from their residence without notice of judgment. This eviction has left them homeless and in financial distress.
The lawsuit accuses Continental Properties of violating federal housing discrimination laws and breaching fiduciary duties by not properly handling the securities associated with their lease agreement. The plaintiffs seek damages for lost profits and suffering, along with injunctive relief to prevent further unjust practices by the defendants.
