The Arizona Court of Appeals has reversed a previous decision in a property dispute involving allegations of unauthorized property conveyance. The Bukharian Jewish Congress of Arizona filed the complaint on December 31, 2025, against Revital Zadikov and others in the Superior Court of Maricopa County. The case revolves around the alleged unauthorized transfer of property by Zadikov, who was accused of falsely claiming to be the CEO of Bukharian Jewish Congress.
According to court documents, the Bukharian Jewish Congress owned Parque Vista Estates, a property that became the center of this legal battle. In July 2021, Revital Zadikov filed annual reports for Bukharian listing herself as CEO and subsequently executed a series of property transfers starting with conveying it to herself. This action set off a chain reaction resulting in four transfers that included Wholesalezon LLC and Crown Servicing, LLC before ending with RSTK Phoenix Owner I, L.P., which claimed bona fide purchaser status.
Bukharian contends that Zadikov had no authority to execute these transactions and argues that all transfers were void due to her lack of corporate authority. “Zadikov was not the CEO,” claims Bukharian’s complaint, “and therefore had no authority to convey the Property.” Despite this assertion, RSTK moved for summary judgment based on its status as a bona fide purchaser. The superior court initially sided with RSTK, dismissing Bukharian’s claims by ruling that since Zadikov signed as herself and not another person, there was no forgery.
The appellate court’s reversal emphasizes the need to first establish whether Zadikov possessed legitimate authority under Arizona Revised Statutes § 33-401(A) before considering RSTK’s bona fide purchaser defense. Judge Anni Hill Foster stated in her decision that determining if an unauthorized signature constitutes forgery requires understanding if Zadikov was indeed authorized to act on behalf of Bukharian.
Bukharian seeks declaratory judgment affirming its ownership and invalidating all subsequent conveyances initiated by Zadikov. The appeals court has remanded the case back to the superior court for further proceedings consistent with its findings. The ruling also vacates any attorney fees awarded previously to RSTK without prejudice.
