Plaintiff accuses former partner company of breaching battery technology agreement

In a significant legal confrontation, an Arizona-based corporation has accused a Delaware company of breaching a critical technology agreement. Watchdog International, Inc. (WDI) filed a complaint against EnerSys Delaware Inc. in the United States District Court for the District of Arizona on February 5, 2026. The lawsuit centers around allegations that EnerSys violated terms concerning jointly developed battery monitoring and analytics technology.

The dispute traces back to a Consulting and Development Agreement originally signed in 2016 between Electric Applications Incorporated (EAI) and NorthStar Battery Company, L.L.C., which was later acquired by EnerSys. This agreement aimed to develop a Smart Battery System and related technologies. According to WDI, EnerSys failed to uphold its end of the bargain by abandoning multiple patent applications related to this project without assigning them to WDI as required by their agreements. Furthermore, WDI claims that EnerSys is unlawfully exploiting these technologies in fields reserved exclusively for WDI without consent.

Watchdog International asserts that it holds exclusive rights under the agreements to exploit certain technologies outside of specified fields defined for NorthStar (now EnerSys). The plaintiff accuses EnerSys of making unauthorized use of these technologies through products marketed under various brand names such as Wi-iQ, iQ-Mini, Truck iQ, and Xinx. These products allegedly incorporate Project Technology developed collaboratively under the agreement but are being used without proper licensing from WDI.

WDI seeks several forms of relief from the court, including orders compelling EnerSys to cease using the disputed technology without consent, assign abandoned patent applications back to WDI, and compensate for damages incurred due to breach of contract. They also request injunctive relief to prevent further breaches and seek restitution for unjust enrichment by EnerSys.
