Darren MacDonald has taken a stand against the invasive practices of telemarketing, filing a class action lawsuit against Citiea Realty Group, LLC. The complaint was lodged in the United States District Court for the District of Arizona on January 6, 2026. MacDonald accuses Citiea Realty Group of violating the Telephone Consumer Protection Act (TCPA) by training its real estate agents to make unsolicited cold calls to consumers without their consent.
The crux of MacDonald’s allegations lies in Citiea’s business model, which he claims involves directing its agents to engage in aggressive telemarketing tactics. These include making calls to numbers listed on the National Do Not Call registry and using pre-recorded voice messages. MacDonald argues that these actions are not only intrusive but also illegal under federal law. “Robocalls and telemarketing calls are currently the number one source of consumer complaints at the FCC,” as noted in the complaint, highlighting the widespread disdain for such practices.
MacDonald’s personal experience with Citiea underscores his grievances. He alleges receiving multiple unsolicited calls from an agent named Samuel DeStefano, despite having his phone number registered on the Do Not Call list since 2003. These calls were allegedly part of a broader strategy employed by Citiea to generate leads for their real estate business, leveraging automated technology and disregarding consumer privacy.
In response to these alleged violations, MacDonald is seeking both injunctive relief and monetary damages on behalf of himself and others similarly affected. The lawsuit aims to halt Citiea’s unlawful telemarketing activities and secure compensation for those who have suffered due to these practices. Specifically, MacDonald seeks statutory damages for each violation of the TCPA, potentially amounting to $1,500 per call if deemed willful.
Representing MacDonald are attorneys Nathan Brown from Ilumi Law and Rachel E. Kaufman from Kaufman P.A., who are advocating for class certification to address this issue collectively rather than through individual lawsuits. The case is under Case No. 2:26-cv-00076-DJH.
